If there is to be any hope of restoring abortion rights nationwide, it is imperative that President Biden direct the National Archivist to certify and publish the Equal Rights Amendment (ERA) as the 28th Amendment to the Constitution. This is because:

1. Dobbs v. Jackson Women’s Health Organization holds that “[t]he Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including…the Due Process Clause [Section 1] of the Fourteenth Amendment.”

2. The Tenth Amendment reserves to the states the powers not delegated to the federal government by the Constitution, nor prohibited by it to the states. The Supreme Court has interpreted this amendment as prohibiting Congress from “commandeering” such powers.

3. Therefore, unless and until Dobbs is reversed, the authority to regulate abortion rests solely with the states and there is no constitutional basis for a national right to abortion.

The ERA states “Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex." This simple statement could provide a constitutional basis for reversing Dobbs and guaranteeing all persons, regardless of sex, the same right to make decisions regarding their bodies, including medical interventions.

I truly hope that pro-choice attorneys and OBGYNs, etc. are coming up w/counter rhetoric & language to fight all of this injustice & nonsense. They've shown that they don't care about facts, reason, compassion, or anything that is actually best for women or girls literally fighting for their lives, in many cases.

There's a factual documentary that was produced/released prior to the Roe debacle, and though I haven't watched it yet, one IMDb review calls it fiction. Like just WTAF is wrong w/people?! They would rather believe a bunch of nut jobs ranting about holiday displays & being marginalized for being so-called Christians than actually paying attention to real science, facts, & research. I'm incensed right now at all of this insanity.

Also they need to stop saying "alternative facts" Um, you mean that's your opinion, how you feel, or what you believe.

I truly do NOT understand how Az voted to protect abortion rights and elect Gallego to the Senate, and then went and voted for the rapist who can make their other two choices null and void...the disconnect is just un-freaking-believable.

Jessica—Can you clarify what you mean by large (advocacy) groups? Do you mean groups like PPFA? The groups sponsoring the ballot initiatives? I just gave a ton of money NNAF and the Abortion Care Network, because I believed that it would filter down to local abortion funds and small independent clinics, with minimal administrative costs. Was I mistaken in that assumption?

Thanks Jessica. All I can say is for people to take care of themselves first. Get emergency contraception, mifepristone ahead of time, get birth control that works best and condoms. Get a VPN for your computer phone. Get all your friends who you can trust be your support team. Get signal app it’s encrypted. Self preservation is critical

The New Yorker also just ran a piece about an OBGYN residency program in the Rio Grande Valley that was forced to close its doors due to the hostile legal climate.

It's worth considering that the "trafficking" BS is also part of efforts to portray women as weak and incapable of acting in their best interest-so they need the state to do that. It's a step toward disenfranchisement.

Indeed. They think we are so bubbleheaded that we can't decide anything for ourselves, about our own bodies, about our own lives. We can't be allowed to make any sort of choices. Thus--rape is OK because it's their choice, and we have no choice. Thus--forced marriage, forced childbearing, and much, much more.
