The reporting today on the suit that Mitchell has filed in Eunice NM seems alarming. I'm trying to read the suit. Not a lawyer. Trying to understand it: "Federal law imposes criminal liability on every person who ships or receives abortion pills or abortion-related paraphernalia through the mail, , an express service, a common carrier or 'interactive computer service.'" Guess that's telehealth, internet commerce... Didn't know they had that in 1873.

So this lawsuit is filed in state court. Because states' supreme courts usually match the partisan lean of their states (there are exceptions like Kansas), most state supreme courts in blue states will probably rule that the laws their states have passed protecting abortion are okay (just as the courts in red states are ruling that laws banning abortion are okay). The problem is that the enemy is already moving on from state level policies, and is working on their next attack, which is to get federal law to force anti-abortion policies on everyone. That can only be done by the federal government, so the federal courts are their ultimate target (since they're not realistically winning any elections on this issue). And that means in the end it's the supreme court. The universe has a sick sense of humor to make the fate of American women be decided by Justice Dirtbag (BK). But it's that or overthrow the system.

Right. Which would require at least a tiny bit of Republican cooperation. Which would actually be good for their party because it would dampen at least a little bit of the anger. But everything they've done so far indicates they're more afraid of their own crazies than they are the rest of us, so, unless that changes, or unless a small group of rebels manage to act against leadership, I don't see it happening.

It's sort of like there's a fail-safe in our system, in case patriarchy and white men ever find their grip seriously threatened. And it's been activated, arguably starting when Obama won, but definitely when Hillary looked to be the probable president. And they're just running with it because they know this is their last shot.

With Biden it might be especially obvious, but ALL of our elected officials seem to not be up to the task. The enemy is moving much faster than us, and while our people are still surprised and trying to work within a rigged system, they're working on figuring out how to use 'the law' to get a nationwide abortion ban without even having to elect a Republican president.

I wonder what's the population of Republican women out there like her who STILL don't get it but might actually have enough of the tiniest bit of self-respect to consider sitting out the next election or voting Democrat? You'd think anyone who is still there is never going to leave but I guess you never know. And that's assuming we even make it to the next election.

Student For Life literally believes that birth control somehow causes more abortions? This woman is clearly in a panic because she sees the writing on the wall but is evidently so blinded to the total dearth of logic by these people.

I'm turning forty next year and decided it's not worth having kids these days. Certainly not worth dying over. They really don't give a damn if we die. They literally want us to be martyrs in their cause. And I refuse to be a part of that crap.

Yes, but of course that's how they've won. If twenty years from now the world is a better place and you wish you had a young adult or two who was calling you mom and would be around as you grow old, you won't have that, and you never will. They've managed to permanently alter your one life or at least eliminate your choices in that one life, and that's as bad as anything any human can to do another. We don't even need forced births or pregnant women in the ICU to see how evil they are. And I guess we have to accept what we can't change, but goddamnit.

I was always on the fence about it. Making the choice to have kids is kinda like getting a face tattoo. You kinda want to be fully committed. I was always half assed committed and now I'm not feeling committed at all. I've always wanted to take in a mom though. Foster care and adoption are just too unethical.

That's a good idea, a really good idea. I just hate what they're doing to people. But yes that would be a really good solution. I don't have kids but I have one niece and she'll be 15 next week. You can definitely be an important part of their life without being the parent.

I really wanted two living children, but I’m probably going to be one and done. It’s so risky now with all the restrictions. Montana is ready blanket outlaw D&E so if anything happens, I’m better off drive 9 hours to Fort Collins and hoping I don’t bleed out before I make it there.

It's quite terrifying. If I had kids, I'd want at least two but I decided it's either two kids or no kids and so it's looking like just no kids. I know so many people don't have the option of moving but I was thinking about leaving Texas for New Mexico. But then there's always the risk of a national abortion ban.

I'm pretty sure that's exactly what's covered by the first amendment, which is why it's so problematic. We need to remember that the bill of rights was written by white men with power FOR white men with power, and the arguments that it protects the vulnerable are the story we get sold in America to try to get us to disbelieve what we're seeing with our own eyes.

If a healthcare provider gives bad medical advice that can legally be addressed by the licensing boards in the state and if they cause damage to a person they can be used for medical malpractice.

Yes but they've infiltrated the licensing boards too, they're very careful to make sure they do that. Has any Catholic health care organization ever been successfully sued for refusing to provide a medically necessary abortion? And I don't think the 'crisis pregnancy centers' are bound by any medical regulations?

If a person comes into the ER they have an obligation under EMTALA to stabilize before releasing that gives people a medical malpractice claim. So they could say they don’t provide abortions as long as the person is stable and it is medically reasonable for them to send them out for care. Not an expert on specific rules. Where I live there are other close options but in less populated area this could add up to an access issue.

Crisis pregnancy centers are not medical centers and they have lawyered up to walk the fine line. NJ has a consumer alert about CPCs. They also aren’t subject to HIPAA so they can freely use information provided to them and some require ID.

Reports on a license may not lead to action but they might have some think twice about sharing medically inaccurate information.

I fear the country will come apart whether or not a Republican gets voted in. The fanatical right has figured out how to unwind everything. While they can't yet pass it nationally, they are trying on the local level. Look at this suit in NM now. Town ordinances based not on not having, say, a Planned Parenthood in town, but on not being able to send or receive abortion medication ?
