In the passage you highlighted, (1) and (2) say 'against' -- these are people who cannot be sued -- but (3) says 'by'. In other words, I think this is saying that the rapist cannot be the one _bringing_ the lawsuit against someone who helped their victim get an abortion. They are not exempt from being sued.
